Whether there’s an immediate solution to judges’ appointment issue in BHC? QUETTA: For how long the discrimination of federation with Balochistan would remain continued in different sectors, no body can answer this just because keeping the past experience in the view. The past experience is that the federation has always lingered unnecessarily certain issues pertaining to Balochistan and its people that later caused mess most of the time. One is right to have the perception that the Balochistan seems on to be the least priority of the federation, and the longstanding issue of the appointment of the judges in the Balochistan High Court (BHC) is one fine example of that. It is now an open secret that the apex provincial court is working only with five honourable judges, means half of the sanctioned strength that stands 10. Despite necessary approval from the concerned quarters for appointment of more judges in BHC, no action whatsoever has so far been taken to address the issue, thanks to those who are in the helm of the affairs and obviously want to hold a status quo in the situation. It is now around four years lapsed when the last induction of a judge in the BHC had been taken place, and since then no new judge has been made part of the top provincial judiciary. What’s important to mention here is that other high courts of the country are almost working at their full strength, but in Balochistan, the strength of the judges is half than the total strength as mentioned earlier making it a unique case in the country’s judicial history. In Punjab, there are three full fledge benches of the High Court i.e., Rawalpindi, Multan and Bahawalpur, in addition to the Lahore High Court where presently the strength of the total judges becomes 33. Since December 1, 2004, a total of 25 judges had been appointed in the LHC and since February 9, 2008, a total of 10 judges were inducted in the high court. But since last four years, as mentioned earlier, no induction was made in the BHC forcing the people to think especially those who matter that whether all the federating units are being treated on equal footings or there’s a marked incongruity in the affairs particularly when it comes to talk about the issues of the province. The irony is also that names of at least two judges had also been approved from Balochistan for the appointment of judges, but their cases were not considered mainly for the judicial crisis in the country. One must ask whether the crisis was just for Balochistan and why the appointments were made in other parts of the country. But, one has to take this in mind that this happens in other provinces, not in Balochistan, which as mentioned is the victim of the discrimination, highhandedness and unjust conduct on part of the establishment. One was expecting much more from the present government of the PPP, which claims itself to be the champions of the rights of the oppressed people and the smaller provinces, and above all, to be the protectors of the rights of Balochistan, but it seems it has no time to deal with the burning issues of the province, but to fuss over other issues.
